Acceptance of terms

By accessing or using the ARQ Biolabs website (arqbiolabs.com) and our analytical testing services ("Services"), and in particular when creating a portal account or submitting a sample for analysis, you agree to be bound by these Terms of Use. If you do not agree, please do not use our Services.

Description of services

ARQ Biolabs provides independent analytical testing on peptides, hGH, TRT compounds and related substances submitted to us as samples. Our Services include:

• HPLC and LC-MS analysis for identity and purity
• Endotoxin (LAL) testing
• Issuing a Certificate of Analysis (COA) with method statement and QR-based verification
• A client portal for sample requests, status tracking and COA download

ARQ Biolabs is an analytical service provider. We do not sell, prescribe, dispense, formulate, recommend or advise on the use of any tested material.

User accounts

To access certain features you may need a portal account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

User conduct

When using our Services you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Submit false or misleading information about the sample, its origin or its claimed identity
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt our Services

Sample requests and results

When you submit a sample for analysis:

• You confirm that you have the legal right to possess and submit the sample under the laws of your jurisdiction.
• You agree to provide accurate intake information; analyses are run blind, but jurisdictional and safety information must be truthful.
• You understand that turnaround times are indicative and that results are not guaranteed in any particular form: a result is whatever the sample produces under the stated method.
• You acknowledge that the analytical data and the COA are issued by ARQ Biolabs and remain the intellectual property of ARQ Biolabs; you receive a license to use the COA in support of your own product, customer or clinical decision-making.
• You acknowledge that test results are informational only and do not constitute medical advice.

Fees and payments

Some Services require payment at the time of request. Where a fee applies, the amount and applicable VAT will be shown before you confirm your submission.

• Subscription fees (Clinic Pack, Vendor Pack, Enterprise) are billed annually, ex VAT.
• One-off test fees are non-refundable once analysis has started.
• If you request cancellation before analysis has started, we will release any payment authorisation at no charge where possible.
• Prices are subject to change; the price shown at the time of your submission is the price you pay for that submission.

Sample handling and retention

• Samples submitted to ARQ Biolabs are not returned.
• Samples that fall outside the scope of the requested analysis may be discarded without further notice.
• Tested samples are retained under temperature-controlled storage for 30 days after the COA has been issued, after which residual material is destroyed in accordance with our standard operating procedure.
• By submitting a sample you consent to its handling, analysis and eventual destruction as part of the testing process.

Intellectual property

All content on our website and in COAs we issue, including text, graphics, logos, methods documentation, chromatograms and result tables, is the property of ARQ Biolabs (or its laboratory partners where indicated) and is protected by intellectual property laws. You may not:

• Copy, modify or redistribute our content beyond the scope of the licence granted to you with a paid COA
• Use our content for commercial purposes without a written licence
• Remove any copyright or proprietary notices from a COA

Disclaimers and limitations of liability

Our Services are provided "as is" without warranties of any kind, except as required by mandatory provisions of applicable law. ARQ Biolabs:

• Does not provide medical, pharmaceutical or therapeutic advice
• Does not guarantee that an analytical result reflects the bulk material a sample was drawn from
• Is not liable for indirect, incidental or consequential damages arising from your use of our Services
• Is not responsible for decisions you, your customers or your patients make based on a COA

This website is provided for educational and informational purposes only and does not constitute medical advice or professional services. The information provided is not intended to diagnose, treat, cure or prevent a health problem or disease. Anyone seeking personal medical advice should consult a licensed physician. None of the statements on this site have been evaluated by the EMA, the FDA or any other regulatory authority.

The COAs and analytical results provided by ARQ Biolabs reflect the testing performed on the specific samples submitted, under the methods stated on each COA. They do not constitute an endorsement, recommendation or therapeutic claim by ARQ Biolabs about any product, vendor or compound.

Termination

We reserve the right to suspend or terminate your account and access to our Services at any time and without notice, in particular where we have reasonable grounds to believe that the account is being used in violation of these Terms or applicable law.

Governing law

These Terms of Use are governed by the laws of the Netherlands. Disputes that cannot be resolved amicably will be submitted to the competent court in the Netherlands.

Changes to these terms

We may update these Terms of Use from time to time. Material changes will be communicated by posting a notice on the website and, for active subscribers, by email to the address associated with the portal account.

Algemene voorwaarden

Acceptatie van voorwaarden

Door gebruik te maken van de website van ARQ Biolabs (arqbiolabs.com) en van onze analytische testdiensten ("Diensten"), en in het bijzonder bij het aanmaken van een portal-account of het insturen van een sample voor analyse, gaat u akkoord met deze algemene voorwaarden. Bent u niet akkoord, gebruik onze Diensten dan niet.

Omschrijving van de diensten

ARQ Biolabs verzorgt onafhankelijke analytische tests op peptiden, hGH, TRT-compounds en aanverwante stoffen die als sample bij ons worden ingediend. Onze Diensten omvatten:

• HPLC- en LC-MS-analyses voor identiteit en zuiverheid
• Endotoxine (LAL) bepalingen
• Het uitgeven van een Certificate of Analysis (COA) met methodevermelding en QR-verificatie
• Een client portal voor sample-aanvragen, statusinformatie en COA-download

ARQ Biolabs is een analytische dienstverlener. Wij verkopen, voorschrijven, verstrekken, formuleren, adviseren of bevelen geen geteste materialen aan voor enig gebruik.

Gebruikersaccounts

Voor bepaalde functies heeft u een portal-account nodig. U bent verantwoordelijk voor:

• De vertrouwelijkheid van uw inloggegevens
• Alle activiteit die onder uw account plaatsvindt
• Het direct melden van onbevoegd gebruik van uw account

Gebruikersgedrag

Bij gebruik van onze Diensten gaat u ermee akkoord dat u niet:

• Toepasselijke wet- en regelgeving overtreedt
• De rechten van anderen schendt
• Onjuiste of misleidende informatie over het sample, de herkomst of de geclaimde identiteit verstrekt
• Onbevoegd toegang probeert te krijgen tot onze systemen
• Onze Diensten verstoort of onderbreekt

Sample-aanvragen en resultaten

Bij het insturen van een sample:

• Bevestigt u dat u het wettelijke recht heeft om het sample in uw jurisdictie te bezitten en in te sturen.
• Verstrekt u juiste intakegegevens. Analyses worden blind uitgevoerd, maar veiligheids- en jurisdictiegegevens moeten kloppen.
• Begrijpt u dat doorlooptijden indicatief zijn en dat resultaten niet in een bepaalde vorm worden gegarandeerd: een resultaat is wat het sample oplevert onder de gehanteerde methode.
• Erkent u dat de analytische data en de COA worden uitgegeven door ARQ Biolabs en eigendom blijven van ARQ Biolabs. U ontvangt een licentie om de COA te gebruiken voor uw eigen product, klant of klinische besluitvorming.
• Erkent u dat testresultaten uitsluitend informatief zijn en geen medisch advies vormen.

Tarieven en betaling

Voor sommige Diensten wordt op het moment van aanvraag betaald. Bedragen en btw worden getoond vóór bevestiging.

• Abonnementen (Kliniek-Pack, Vendor Pack, Enterprise) worden jaarlijks gefactureerd, excl. btw.
• Tarieven voor losse tests zijn niet restitueerbaar zodra de analyse is gestart.
• Bij annulering vóór aanvang van de analyse wordt een eventuele betaalautorisatie kosteloos vrijgegeven waar mogelijk.
• Tarieven kunnen wijzigen; het tarief op het moment van uw aanvraag is het tarief dat u betaalt.

Sample-handling en retentie

• Bij ARQ Biolabs ingediende samples worden niet geretourneerd.
• Samples die buiten de scope van de aangevraagde analyse vallen, kunnen zonder verdere aankondiging worden vernietigd.
• Geteste samples worden 30 dagen na het uitgeven van de COA bewaard in temperatuurgecontroleerde opslag, daarna wordt het restmateriaal vernietigd volgens onze SOP.
• Met het insturen van een sample stemt u in met de behandeling, analyse en uiteindelijke vernietiging als onderdeel van het testproces.

Intellectueel eigendom

Alle content op onze website en in door ons uitgegeven COAs, waaronder teksten, grafische elementen, logo's, methodedocumentatie, chromatogrammen en resultatentabellen, is eigendom van ARQ Biolabs (of van een aangewezen partnerlab) en is beschermd door intellectuele eigendomsrechten. U mag niet:

• Onze content kopiëren, wijzigen of herdistribueren buiten de met een betaalde COA verleende licentie
• Onze content commercieel gebruiken zonder schriftelijke licentie
• Copyright- of eigendomsvermeldingen van een COA verwijderen

Disclaimer en aansprakelijkheidsbeperking

Onze Diensten worden geleverd "as is", zonder enige garantie, behoudens dwingendrechtelijke bepalingen van het toepasselijk recht. ARQ Biolabs:

• Verstrekt geen medisch, farmaceutisch of therapeutisch advies
• Garandeert niet dat een analytisch resultaat representatief is voor de bulkpartij waaruit het sample is genomen
• Is niet aansprakelijk voor indirecte, incidentele of gevolgschade voortvloeiend uit uw gebruik van onze Diensten
• Is niet verantwoordelijk voor beslissingen die u, uw klanten of uw patiënten nemen op basis van een COA

Deze website is uitsluitend bedoeld voor educatieve en informatieve doeleinden en vormt geen medisch advies of professionele dienst. De informatie is niet bedoeld om een gezondheidsprobleem of ziekte te diagnosticeren, behandelen, genezen of voorkomen. Voor persoonlijk medisch advies dient u een arts te raadplegen. Geen van de uitspraken op deze site is geëvalueerd door de EMA, de FDA of enige andere toezichthouder.

De COAs en analyseresultaten van ARQ Biolabs weerspiegelen de uitgevoerde tests op de specifiek aangeleverde samples, onder de op de COA genoemde methoden. Ze vormen geen aanbeveling, endorsement of therapeutische claim van ARQ Biolabs over enig product, vendor of stof.

Beëindiging

Wij behouden ons het recht voor uw account en toegang tot onze Diensten op elk moment en zonder voorafgaande kennisgeving op te schorten of te beëindigen, in het bijzonder wanneer wij redelijke grond hebben om aan te nemen dat het account in strijd met deze voorwaarden of het toepasselijk recht wordt gebruikt.

Toepasselijk recht

Op deze algemene voorwaarden is Nederlands recht van toepassing. Geschillen die niet in onderling overleg kunnen worden opgelost, worden voorgelegd aan de bevoegde rechter in Nederland.

Wijzigingen

Wij kunnen deze algemene voorwaarden van tijd tot tijd aanpassen. Materiële wijzigingen worden gecommuniceerd via een melding op de website en, voor actieve abonnees, per email naar het adres dat aan het portal-account is gekoppeld.
